The following General Terms and Conditions (GTC) apply to all orders placed via our website. The offer on this website is aimed exclusively at consumers residing in Switzerland (hereinafter "customer").

A consumer is defined as a natural person who maintains a business relationship with DNA that cannot be attributed to their commercial or independent professional activity. Orders in quantities that are not usual for households may be rejected without justification.

DNA reserves the right to change these terms and conditions at any time. The version of these terms and conditions valid at the time of the order is decisive and cannot be changed unilaterally for this order. Customer conditions that conflict with or deviate from these terms and conditions will not be recognized.

3. PRIZES
The sales prices indicated on DNA represent final prices and, unless otherwise stated, include statutory value added tax and any other statutory fees such as advance recycling fees (VRG) or copyright fees for electronic devices. The prices are net and in Swiss francs (CHF).

Unless otherwise stated, any shipping costs will be charged additionally and must be paid by the customer. Shipping costs are shown separately in the ordering process.

Technical changes, errors and misprints are reserved. In particular, DNA reserves the right to make price changes at any time and without prior notice. The sales prices do not include any consulting or support services.

4. CONCLUSION OF CONTRACT
The products and prices on this website are non-binding offers.

By placing an order via this website, including acceptance of these terms and conditions, the customer makes a legally binding offer to conclude a contract. DNA then sends an automatic order confirmation by email, which confirms that DNA has received the customer's offer. Orders placed are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal.

The contract is concluded as soon as DNA sends a declaration of acceptance by email, confirming the dispatch of the ordered products or services.

Orders will only be delivered after full payment has been received (exception: delivery against invoice) and provided the goods are available. If it turns out that the ordered goods cannot be delivered or cannot be delivered in full, DNA is entitled not to accept or execute the order or to only accept it in part. In such a case, DNA will inform the customer by email. If DNA has already received the customer's payment, the payment will be refunded to the customer. If no payment has yet been made, the customer is released from the obligation to pay.

5. PAYMENT OPTIONS AND RESERVATION OF TITLE
The customer has access to the payment options specified during the ordering process.

DNA reserves the right to exclude customers from certain payment options or to insist on payment in advance without giving reasons.

If the customer defaults on payment, DNA may charge interest on arrears of 5% per year and a reminder fee of a maximum of CHF 20 per reminder.

The products delivered to the customer remain the property of DNA until full payment has been made.

Purchase on account with installment payment option (POWERPAY)

As an external payment service provider, MF Group / POWERPAY offers the payment method “purchase on account”. With the individual invoice, you can easily pay for your online purchase by invoice. If you do not make a payment within the specified time frame, you will subsequently receive a monthly invoice with an order overview in the following month.

When the purchase contract is concluded, POWERPAY takes over the invoice claim and handles the corresponding payment terms. When purchasing on account, you accept POWERPAY's terms and conditions in addition to our terms and conditions. (powerpay.ch/de/agb).

6. DELIVERY, INSPECTION OBLIGATION, NOTICE OF DEFECTS AND RETURN
Deliveries will be sent by post or courier service to the address indicated by the customer in the order.

DNA endeavours to keep delivery times as short as possible. However, any delivery times stated in the order confirmation are non-binding. DNA is entitled to make partial deliveries. In this case, the customer will only be charged for shipping costs once.

The invoice, if delivery against invoice is offered, will be sent by email or by post at DNA’s discretion.

If the delivery cannot be made or if the customer refuses to accept the delivery, DNA may terminate the contract after notifying the customer by email and observing a reasonable grace period and invoice the costs for the effort.

The customer is obliged to inspect the delivered goods immediately after receipt of the delivery and to report any defects for which DNA provides a guarantee immediately in writing by letter or email to the address in the imprint (www.dnasup.com/impressum).

Returns to DNA are at the customer's expense and risk. The customer must send the goods in their original packaging, complete with all accessories and together with the delivery note and a detailed description of the defects to the return address provided by DNA (www.dnasup.com/impressum).

If DNA's inspection reveals that the goods do not have any detectable defects or that they are not covered by the manufacturer's warranty, DNA may charge the customer for the costs of returning the goods or any disposal.

7. RIGHT OF WITHDRAWAL
"Please note that there is no right of withdrawal for our products. We offer our goods at low prices by not being able to offer our customers a return guarantee. However, if you have a problem with your order, please contact our customer service and we will do our best to find a satisfactory solution. However, we ask that you carefully check whether you want to order the products you want before placing your order."

DNA reserves the right to demand appropriate compensation for damage, excessive wear and tear or loss of value due to improper handling and to deduct the loss in value from the purchase price already paid or to invoice the customer.

No right of withdrawal is granted in the following cases:

If the contract has an element of chance, in particular because the price is subject to fluctuations over which the supplier has no control;
If the contract concerns a movable item which, due to its nature, is not suitable for return or is liable to spoil quickly;
If the contract concerns a movable item that is manufactured according to the customer's specifications or is clearly tailored to personal needs;
If the contract concerns digital content and this content is not made available on a fixed medium or if the contract is to be fully performed immediately by both parties;
If the contract concerns a service and the contract is to be fully performed by the provider with the prior express consent of the customer before the withdrawal period has expired.
In the areas of accommodation, transport, food and drink delivery and leisure activities, where the provider undertakes, at the time of conclusion of the contract, to provide the services at a specific time or within a precisely specified period.


8. WARRANTY
DNA endeavors to deliver goods of impeccable quality. In the case of defects reported in a timely manner, DNA guarantees that the item purchased by the customer is free of defects and functional during the statutory warranty period of usually two years from the delivery date. It is at DNA's discretion to provide the guarantee by repairing it free of charge, providing an equivalent replacement or by refunding the purchase price. Other warranty rights are excluded.

The warranty does not cover normal wear and tear, the consequences of improper handling or damage by the customer or third parties, or defects that are due to external circumstances. The warranty also does not cover consumables and wearing parts (e.g. batteries, rechargeable batteries, etc.).

DNA is unable to provide any assurances or guarantees that the data is up-to-date, complete and correct, or that the website, its functionalities, integrated hyperlinks and other content will be available at all times or without interruption. In particular, DNA neither provides any assurances nor guarantees that the use of the website will not infringe the rights of third parties who are not owned by DNA.

9. LIABILITY
DNA excludes all liability, regardless of its legal basis, as well as claims for damages against DNA and against any auxiliary persons and vicarious agents. In particular, DNA is not liable for indirect damage and consequential damage, lost profits or other personal injury, property damage or purely financial loss suffered by the customer. Further mandatory statutory liability, for example for gross negligence or unlawful intent, remains reserved.

DNA uses hyperlinks solely to simplify the customer's access to other web offerings. DNA cannot know the content of these web offerings in detail, nor can it accept liability or other responsibility for the content of these websites.

10. DATA PROTECTION
DNA may process and use the data recorded during the conclusion of the contract to fulfill the obligations arising from the purchase contract and for marketing purposes. 11. INVALIDITY OF PARTITION
Should individual provisions of these General Terms and Conditions prove to be invalid or unenforceable or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

DNA expressly reserves the right to change these Terms and Conditions at any time and to put them into effect without notice.

In the event of disputes, Swiss substantive law shall apply exclusively, excluding conflict of law rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.

The place of jurisdiction is the location/headquarters of DNA.
